Business Sponsorship Visas

The 457 (Sub-Class) Visa is the mechanism used by Australian businesses for temporary business sponsorships. The 457 Visa is issued for a period of between 3 months to 4 years.

Both the employer and employee are thoroughly assessed by the Department of Immigration and Citizenship (DIAC) against strict criteria during the three-step process. The process can be significantly drawn out, or worse, applications may be refused, if the content and supporting documentation is not fully compliant with DIAC's criteria. A high level overview of the Three Step Process is:

1) Sponsorship
The Australian Employer applies for approval to be a business sponsor. Financial, training and organisational details form part of the supporting documentation. The Employer needs to commits to specified sponsorship undertakings.

2) Nomination
The employer nominates the occupations and number of each position to be filled by an overseas employee. Each position needs a job description and must comply with criteria, which includes remuneration and skill thresholds.

3) Employee Application
The prospective employee applies for a 457 visa and needs to demonstrate that the required skills to match the nominated position.

DIAC's Monitoring Unit will periodically check that sponsorship undertakings are being met by the employer and employee throughout the sponsorship period.
